A No-Deal Brexit – proposed VAT & Customs Legislation

With 100 days to go before the 29th March Leave date the UK Government is issuing further proposed legislative orders which will be enacted should a No Deal situation arise. Proposed Statutory instruments here provide VAT specific arrangements on how to check for a Valid UK VAT number – which businesses would normally do through the EU based VIES online system – and on requirements for on-line marketplaces when dealing with Postal Imports.

Other proposals look at the recording of Customs Statistical Information to continue to provide the required economic data on the balance of trade that the UK has with the rest of the world. Currently for EU movements this is collected through the Intrastat and the EU Sales List and plans have to be in place to ensure this data can still be collected. Whilst the route for this information may be through Customs Declarations made at the point or entry or departure   (i.e.- through HMRC data collection at that point) it is not wholly clear yet that the Intrastat; as a form that a UK Business has to submit; will disappear immediately.

Whilst nothing is certain there are conversations that can be had about what the VAT arrangements and movements of Goods could look like and modelling can be done on impact areas in a range of scenario’s.
